1. Purpose
These Terms of Use (hereinafter the Terms of Use) are intended to define the terms and conditions under which the company Tribulys (hereinafter Tribulys or we) makes available to users (hereinafter the User or you) the caregiver coordination platform accessible at tribulys.fr (hereinafter the Service).
The Service enables a group of people (family members, professional care providers such as nurses, physiotherapists, home care assistants or doctors) to coordinate the care of a person supported at home through a shared care journal, a multi-participant calendar and medication tracking.
2. Access to the Service and Registration
2.1 Access Conditions
The Service is accessible to any adult natural person with the legal capacity to enter into contracts under the law of their country of residence. Minors may only access the Service with the express authorisation of their legal representative, who remains responsible for its use.
Access to the Service requires an Internet connection and a compatible browser or device. Tribulys does not guarantee compatibility with all hardware or software configurations.
2.2 Account Creation
To access the Service's features, the User must create an account by providing a valid e-mail address and choosing a secure password. The User warrants that the information provided during registration is accurate, complete and kept up to date.
Only one account is permitted per natural person. Creating multiple accounts for fraudulent purposes is prohibited.
2.3 Security of Login Credentials
The User is solely responsible for the confidentiality of their login credentials and for any use made of their account. Any unauthorised use must be reported without delay to contact@tribulys.fr.
3. Description of the Service and Plans
The Service is offered under two plans:

Prices are shown in euros, all taxes included. Tribulys reserves the right to change its prices at any time, subject to informing the User at least 30 days before any change affecting an ongoing subscription.
4. Financial Terms and Payment
4.1 Billing
The Premium subscription is billed monthly, on the anniversary date of the subscription, by automatic debit from the registered payment method. Billing begins at the end of the 14-day trial period if the User has not cancelled before it ends.
4.2 Payment Service Provider
On the Web, payments are processed by Stripe Payments Europe, Ltd. (1 Grand Canal Street Lower, Dublin 2, Irlande), an authorised payment service provider. In the iOS application, subscriptions are purchased and billed via Apple In-App Purchase (Apple Distribution International Ltd., Hollyhill Industrial Estate, Cork, Irlande), in accordance with App Store rules. In the Android application, subscriptions are purchased and billed via Google Play Facturation (Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Irlande), in accordance with Google Play Store rules. In both cases, management, changing the payment method and cancellation are carried out from your Apple or Google account settings, not from the Service. Tribulys never stores bank card data. By making a payment, you also accept, depending on the method used, the Stripe Terms of Use, the Apple Media Services Terms and Conditions, or the Google Play Terms of Service.
4.3 Right of Withdrawal
Pursuant to articles L. 221-18 et seq. of the French Consumer Code (Code de la consommation), the consumer User has a 14-day withdrawal period from the date of subscription. Exercising this right entails the full refund of amounts paid within 14 days of notification.
Exception: by clicking Start free trial, the User expressly acknowledges having requested immediate access to the Service during the trial period. As no amount is charged during the first 14 days, the right of withdrawal may be exercised free of charge during the trial simply by cancelling.
4.4 Eligibility for the Tax Credit
Under certain conditions, Tribulys may be used in connection with in-home personal care services (services à la personne, SAP) eligible for the 50% tax credit provided for in article 199 sexdecies of the French General Tax Code (Code général des impôts), where it is subscribed jointly with a personal care service provided by an approved organisation. It is the User's responsibility to verify eligibility.
5. Termination
5.1 By the User
The User may cancel their Premium subscription at any time from their Settings → Subscription area, or by contacting contact@tribulys.fr. Termination takes effect at the end of the current billing period. No pro-rata refund is made, except where legally required.
Full deletion of the account results in the permanent deletion of all associated data within 30 days, subject to legal retention obligations (billing data kept for 10 years).
5.2 By Tribulys
Tribulys reserves the right to suspend or terminate an account in the event of a breach of these Terms of Use, fraudulent use, non-payment, or infringement of third-party rights, without notice in cases of urgency or proven severity.
6. Obligations and Responsibilities of the User
The User undertakes to use the Service lawfully and in accordance with these Terms of Use. The following are in particular prohibited:
- Any use of the Service for unlawful or fraudulent purposes, or that infringes the rights of others;
- Deliberately entering inaccurate or misleading information;
- Any attempt to gain unauthorised access to Tribulys's computer systems or those of other users;
- Unauthorised resale, reproduction, representation or commercial exploitation of the Service;
- Introducing viruses, malicious software or any code liable to damage the Service or third parties' computer systems.
The User is solely responsible for the content they enter into the Service (notes, observations, documents). Tribulys does not verify this content and disclaims all liability with respect to it.
7. Liability of Tribulys
7.1 Service Availability
Tribulys undertakes to implement reasonable means to ensure the availability of the Service, without being able to guarantee uninterrupted availability. Interruptions for maintenance, updates or technical incidents may occur, preferably scheduled outside peak hours.
7.2 Limitation of Liability
To the extent permitted by law, Tribulys may only be held liable for direct damages resulting from a proven fault on its part. Tribulys is released from all liability for:
- indirect damages (data loss, loss of profit, non-material damage);
- the consequences of misuse of the Service by the User;
- medical or care decisions made on the basis of content from the Service;
- interruptions caused by external factors (Internet outage, force majeure).
In any event, Tribulys's liability is capped at the amounts actually paid by the User during the 12 months preceding the event giving rise to liability.
8. Personal Data
The collection and processing of personal data are governed by the Privacy policy of Tribulys, which forms an integral part of these Terms of Use. By accepting the Terms of Use, the User acknowledges having read this policy and gives explicit consent to the processing of their data, including health data entered into the Service, for the purpose of providing the Service.
9. Intellectual Property
The Service and all its components (source code, interface, trademarks, editorial content) are the exclusive property of Tribulys and are protected by French and international intellectual property law.
Tribulys grants the User a non-exclusive, non-transferable and revocable licence to use the Service, strictly limited to personal, non-commercial use, for the duration of their subscription.
The User retains full rights over the data and content they enter into the Service. The User grants Tribulys a license limited solely to operating the Service (display, storage, backup, transmission to authorised members of the circle).
10. Amendments to the Terms of Use
Tribulys reserves the right to amend these Terms of Use at any time. Any substantial change will be notified to the User by e-mail and/or by a notification within the Service, with 30 days' notice. Continued use of the Service after this period constitutes acceptance of the new Terms of Use.
If the User refuses the new terms, they may terminate their account free of charge before the amendments take effect.
11. Governing Law and Jurisdiction
These Terms of Use are governed by French law. Pursuant to articles L. 616-1 and R. 616-1 of the French Consumer Code (Code de la consommation), Tribulys offers consumers a mediation mechanism. The designated mediator is: [médiateur à désigner, par ex. le Médiateur du e-commerce de la FEVAD].
Failing an amicable resolution, any dispute relating to these Terms of Use shall be subject to the exclusive jurisdiction of the French courts. For professional Users, the competent court shall be that of Tribulys's registered office. For consumers, the statutory rules of territorial jurisdiction apply.
The European Commission provides an online dispute resolution (ODR) platform accessible at ec.europa.eu/consumers/odr.
